The United Nations Office for Project Services Jerusalem Operations Centre (UNOPS JMOC) is supporting the Canadian government in the implementation of the Sharaka project — a multi-year DFATD-funded initiative directed at strengthening the Palestinian Office of Attorney General/Public Prosecution (OAG/PP). As part of that support, UNOPS JMOC is looking for a contractor to carry out an assessment of the way in which witnesses are dealt with in the Palestinian justice system.

It is essential to treat all witnesses properly so that they are not reluctant to come forward. The willingness of witnesses to report the offence and later to give evidence in court can be crucial in the detection and successful prosecution of the offender. No less importantly, the willingness of a witness to testify for the defense can be the determining factor in establishing the innocence of an accused.

With that in mind, it seemed important to assess the way in which witnesses are treated in the Palestinian system. The purpose of the assessment is to identify the strengths and weaknesses of the current approach to relations with witnesses. The assessment will provide a reliable factual basis to engage into further discussions with the Palestinian Prosecution Service regarding the measures that could be taken to facilitate the full participation of witnesses in the justice process.
Background Information - Jerusalem

The UNOPS Jerusalem office opened in 2006 and now has sub-offices in East Jerusalem, Ramallah and Jericho. The portfolio includes infrastructure, procurement, human resources, capacity building, access coordination and security projects for partners and beneficiaries throughout the occupied Palestinian territory.
Functional Responsibilities

Purpose and Scope of Assignment

More specifically, the Sharaka Project requires the services of a contractor that will:
-identify — using as a starting point the list of witness assistance measures annexed to the present Terms of Reference — the witness support measures currently in place in the Palestinian system;
-gather information on the real and perceived effectiveness of these measures; and
-obtain suggestions on the actions that could be taken to ensure that witnesses receive an appropriate level of support.

As part of the research, the contractor will be expected to interview representatives from several organizations, including (but not limited to):
-the Palestinian Prosecution Service;
-the Palestinian Bar Association;
-Civilian Police's Family Protection Unit;
-the Institute of Law at Birzeit University;
-the Faculty of Law at An Najah National University;
-the Women's Centre for Legal Aid and Counselling (WCLAC);
-SAWA;
-the Independent Commission for Human Rights (ICHR).

The contractor should also seek the views, in their personal capacity, of various people having a direct knowledge of the functioning of the Palestinian justice system, such as judges and court officials.

The contractor will:
-write a short document describing the steps that will be taken to carry out the work;
-develop a list of the people and organizations that will be consulted;
-submit the above document and list to the Sharaka Field Director so as to obtain input from Canada's Department of Justice;
-carry out the necessary interviews;
-submit for comments to the Sharaka Field Director a draft report accurately summarizing the views expressed by the people and organizations consulted;
-produce the final version of the report, taking into account the comments received from the Sharaka Field Director.

3-Monitoring and Progress Controls
-Submission to the Sharaka Project of methodology document and list of people and organizations to be consulted.
-Submission to the Sharaka Project of a draft of the assessment report.

Education/Experience/Language requirements

a-Education:
MA Degree in Law or other relevant discipline.
A first level university degree with 2 additional years of relevant experience may be accepted in lieu of the advance university degree.

b-Work Experience
-Minimum of 2 years of experience in the field of justice or another relevant field.
-Knowledge of the Palestinian justice system and of the role of the OAG/PP is required.
-Proven experience of report writing/research skills.

c-Languages

Fluency in both the English and Arabic languages, written and spoken skills.
